Terms of Service

1. Service Description

MarketSync (“the Service”, “we”, “us”, “our”) is a software-as-a-service platform that routes trading signals from Telegram groups to MetaTrader 5 (MT5) and MetaTrader 4 (MT4) accounts via the TradeSync execution engine.

MarketSync is an order routing tool only. We parse trading signals published in third-party Telegram groups and forward the corresponding order instructions to your connected broker account. We do not originate, create, endorse, or verify any trading signal.

2. Not Financial Advice

MarketSync does not provide investment advice, financial advice, trading advice, research, or analysis of any kind. Nothing on this platform constitutes a solicitation, recommendation, or endorsement to buy or sell any financial instrument.

All signals are produced by independent third-party providers. We do not review, audit, or guarantee the quality, accuracy, or profitability of any signal or provider.

3. User Responsibilities

By using MarketSync, you acknowledge and agree that:

• You are solely responsible for all trading decisions executed through your connected broker account.
• You are responsible for configuring and maintaining your risk management settings, including lot sizes, stop-loss levels, and maximum open positions.
• You understand the risks of automated order routing and accept that technical latency, connectivity issues, or signal parsing errors may occur.
• You will not use the Service for any unlawful purpose or in violation of any applicable financial regulation.

4. Account Terms

• You must be at least 18 years old to create an account and use the Service.
• You must provide a valid email address during registration.
• You are responsible for maintaining the security of your account credentials. We are not liable for any loss arising from unauthorised access to your account.
• One person or legal entity may maintain only one active account unless expressly authorised in writing.

5. Subscription & Billing

• The standard subscription is $49 per month. An annual billing option may be offered at a discounted rate.
• Payments are processed through our supported payment providers (Helio and/or Stripe). By subscribing you agree to their respective terms of service.
• Subscriptions renew automatically at the end of each billing period unless cancelled prior to the renewal date.
• There is no grace period. If payment fails, your access to signal routing will be suspended until the outstanding balance is settled.
• Refunds are handled on a case-by-case basis and are not guaranteed. Contact support@marketsync.ai for refund requests.

6. Third-Party Services

The Service integrates with and depends upon third-party services, including but not limited to:

• TradeSync — for order execution and broker connectivity.
• Signal providers — independent Telegram groups whose signals you choose to follow.
• Payment providers — Helio and/or Stripe for subscription billing.

We are not responsible for the availability, accuracy, or performance of any third-party service. Downtime or errors in third-party systems may affect signal routing.

7. Risk Acknowledgment

By using the Service, you acknowledge that you understand the risks involved in leveraged trading and that MarketSync bears no responsibility for any financial losses incurred through the use of the platform.

8. Limitation of Liability

To the maximum extent permitted by applicable law, MarketSync and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Losses resulting from signals copied through the Service.
• Service interruptions, delays, or errors in signal routing.
• Unauthorised access to your account or broker credentials.
• Any action or inaction of third-party signal providers, TradeSync, or your broker.

Our total aggregate liability shall not exceed the amount you have paid for the Service in the twelve (12) months preceding the claim.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using MarketSync, you consent to the data practices described therein.

10. Termination

• You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
• We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.
• Upon account deletion, your data will be anonymised within 30 days in accordance with our Privacy Policy.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or an in-app notification at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
